In 2009 over 88,000 summons for disorderly conduct under New York Penal Law 240.20. The charge requires that a person, with intent to causepublic inconvenience, annoyance or alarm, or recklessly creating a risk
thereof: engages in one or more of the following activities:
1. engages in fighting or in violent, tumultuous or threatening
behavior;
2.makes unreasonable noise;
3. uses abusive or obscene language, or makes an
obscene gesture in a public place;
4. disturbs any lawful assembly or
meeting of persons without lawful authority
5. obstructs vehicular or pedestrian traffic; 6. congregates with other persons in a public place and refuses to
comply with a lawful order of the police to disperse;
7. creates a hazardous or physically offensive condition by any act
which serves no legitimate purpose.
